Wedding Photography Contract
terms and conditions

This agreement constitutes an order for wedding photography and photojournalist services, including the taking of wedding pictures as agreed to by both parties: (the photography studio) Modern art Photograph and contracting party (the client). Unless otherwise specified, it is understood that any and all rights to proofs, final or sample prints, thereof shall remain the property of the studio and may be used for advertising, display or any other purpose thought proper by the studio.
Image rights are released on all digital images from this wedding. These images may be printed, copied or duplicated and posted to the Internet, at the sole discretion of the client.
If photographer cannot perform this agreement in whole or in part due to a fire or other casualty, acts of nature or other cause beyond the control of the parties or due to photographer's illness or injury, then studio will return all fees to the client(s) but shall have no further liability with respect to this agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of photographer. Client(s) agree that an entire wedding cannot be replicated, reenacted or repeated for the purpose of a re shoot and limits studio's liability to the amount paid under this contract.
In the event the photographer cannot perform this agreement due to illness or injury, photographer will make every reasonable effort to find a substitute photographer to perform the services. If photographer cannot find a substitute, then the client will receive a refund of all fees paid to date. If photographer is able to find a substitute, then the photographer will forward the deposit paid to the substitute and the client will pay the current agreed-upon final fee to the substitute photographer.
On signing of this agreement, the studio will reserve the time agreed upon and will not make another reservation for the specific time frame. For this reason, all deposits are non-refundable even if the date is changed or if the wedding becomes cancelled for any reason.
The deposit is due at the signing of this agreement. The deposit is half the cost of the package to be purchased. The deposit is non refundable in case of cancellation or date change by client. The remainder is to be paid on the date of the wedding. The payment of all necessary expenses and travel costs, hotel charges etc are to be paid at the date of the event. No photography rights are granted until timely payment is made in full. Failure to pay on the date of the event will result in an additional charge of 10% of the total cost of the package purchased.
Travel fees are only needed for a hotel or air travel. Travel fees are planned before contract signing. Regarding COVID-19; during this time the wedding date may be rescheduled without cost to the client. If the wedding cannot be rescheduled to a date available to the photographer, the deposit can be used toward photography services in the future. The value can be used or transferred to another family.
I the undersigned contracting party, hereby warrant that I am competent to contract in my own name. I confirm that I have read the herein agreement prior to its execution and am fully familiar with the contents thereof.
This agreement shall be binding upon us and our heirs and legal representatives and assigns and we certify that we have received a complete copy of this agreement with all blank lines completed.

How long can I expect before I see my photos?
Answer
Each shoot is a little different. Turn around on a wedding is about two weeks. Turn around on a family photo shoot or other non wedding related shoot can be as little as the same day or as long as 2-3 days.

What is the delivery method for my photos?
Answer
Digital photos are delivered in an email with a download or a few downloads.
Prints and albums are FexEx or UPS.


Question
Once a wedding date is booked can I cancel?
Answer
Yes! You can cancel. However, all deposits paid are not refundable. The amount paid can be used toward other photo shoots or given to others for services, not products.
